A Deed of Separation is a legal document between married partners stating their decision to live separately. It contains the terms and conditions of the relationship during the period of supervision, including terms relating to custody, division of assets and even maintenance issues.
To be valid, a Deed of Separation must state the date of separation of the parties. This document can be used in Divorce Proceedings as evidence of the three- year separation.
A Deed of Separation is a private document and is not submitted to any official government departments. As such, subject to the consent of both parties, it may be revoked at any time. Parties may even reconcile after signing a Deed of Separation.
